1. Purpose

The purpose of these Terms of Use (hereinafter “TOU”) is to define the terms and conditions under which users may access the content of the website designed and published by Yukan and accessible at the address www.glimpact.com, as well as to the “European Global Score” online service and application, which is a Software-as-a-Service (SaaS) solution called “Glimpact”—also designed and published by YuKan, which holds the intellectual property rights to it—accessible at: www.glimpact.com/global-impact-score. This service and online application enable the calculation of the environmental score for all garments in accordance with the methodological framework of the PEF method recommended by the European Commission, based on the sector-specific standard: the “PEFCR Apparel and Footwear,” which has been validated by the Commission. A detailed description of this application can be found in the documentation available online on the website.  

Any use of the website www.glimpact.com and the online application  www.glimpact.com/global-impact-score, implies unconditional acceptance of these Terms of Use.

2. Definitions
‍‍
For the purposes of these Terms of Use, the following terms have the meanings set forth below:

• Glimpact: the SaaS technology known as Glimpact, developed and published by Yukan, which holds the intellectual property rights to it
• Applications: the website www.glimpact.com and all of its editorial content, as well as the online application that utilizes certain features of Glimpact, accessible at: www.glimpact.com/global-impact-score
• User: any person accessing the Applications;
• Service: the full range of features available within the Applications
• Publisher: YuKan.

3. Access to Applications
‍‍
The applications are accessible via any computer or other device with an Internet connection.
The publisher strives to ensure continuous access to the Applications, but does not guarantee that they will be available at all times.  

Access may be temporarily suspended by the Publisher for maintenance, updates, or improvements.

4. Create an account
‍‍
Some services require you to create a user account.
The User:

• guarantees the accuracy of the information they provide when creating their account;
• is responsible for keeping their login credentials confidential;
• agrees to report any fraudulent use of the Applications

5. End User License Agreement
‍‍
The applications are licensed for use free of charge; they are not sold.
The user has the right to access and use the Applications:

• Personnal;
• Non-exclusive;
• Non-transferable.

6. User Obligations
‍‍
The User agrees to:

• comply with applicable laws and regulations;
• do not use the Applications for fraudulent purposes;
• not to deliberately interfere with the operation of the Applications;
• not to infringe upon the rights of third parties.

7. Restrictions

It is strictly prohibited to:

• reproduce, distribute, or commercially exploit the Applications;
• modify, adapt, or create derivative works;  
• reverse engineer;
• circumvent security measures.

8. Intellectual Property
‍‍‍
All elements comprising the Applications (code, design, content, trademarks, logos) are protected by intellectual property laws.
These materials remain the exclusive property of the publisher.
However, the User retains the rights to the content they create through the App www.glimpact.com/global-impact-score

9. Data and contributions

The User may be required to provide:

• Data;
• Suggestions;
• Feedback.

This information may be used by the publisher to improve the service. Any use must comply with applicable regulations, particularly those regarding the protection of personal data.

10. Personal information
‍‍‍
The Publisher may collect certain data necessary for the operation of the Applications. This data is processed in accordance with applicable regulations (including the GDPR).  

The User has the following rights:

• Access;
• Rectification;
• Delete.

11. Service Development
‍
‍‍The Publisher reserves the right to:

• Develop the Applications and their respective Services;
• Correct the errors;
• Improving Applications.

• The User will be notified
• A reasonable timeframe will be observed

12. Liability
‍
The Publisher takes all reasonable measures to ensure the proper functioning of the Applications.  

However:

• Errors or interruptions may occur;
• The service is provided without any guarantee of uninterrupted operation.

The Publisher shall not be liable for any consequential damages. However, the publisher shall only be held liable in the event of gross negligence, negligence, or a violation of the law on its part, provided that such conduct is clearly established.

13. Third-party services

The Apps may contain links to or incorporate third-party Services.
The publisher does not control these third-party services and cannot be held responsible for their content or operation.

14. Termination

The user may stop using the Applications at any time.
The publisher may suspend or terminate access to the Applications:

• In the event of a breach of these Terms of Use;
• For good cause.

Unless it is an emergency, the user will be notified in advance.

15. Changes to the Terms of Service

These Terms of Use may be modified at any time.  

In the event of a substantial change:

• At least 30 days' notice will be provided;
• The User may reject the new terms by ceasing to use the service.

16. Applicable law
‍
These Terms of Use are governed by French law.
Any dispute shall be submitted to the competent courts, unless otherwise provided by law.

17. Partial invalidity
‍
If any provision is found to be invalid, the remaining provisions shall remain in effect.

18. Full text of the contract
‍
These Terms of Use constitute the entire agreement between the user and the publisher.
